TERMS AND CONDITIONS
Dear Customer,
The search and comparison service for legal consultants offered on the Outlet Legale portal is governed by the following General Terms and Conditions, to which the Customer expressly agrees by purchasing the services provided on the portal and paying the relevant fee.
Object of the contract
The object of this contract is the activity, carried out by Outlet Legale through its staff, of research and comparison aimed at finding a Legal Consultant (duly registered in the Register of Lawyers kept by the relevant Bar Association), having his/her domicile within a radius of 50 km from the Customer’s domicile, who is willing to offer his professional services to the customer, submitting to him a quotation for legal advice with terms and conditions consistent, in their essential terms, with the characters from time to time specified on the Outlet Legale portal in relation to each type of legal advice service as illustrated on the Outlet Legale portal.
Therefore, Outlet Legale does not carry out any professional activity of legal advice, either directly or indirectly, but only performs for the exclusive benefit of the customer a scouting and comparison service (in short the “Service”) concerning the profiles of legal advisors operating in the Italian market.
Conclusion of the Contract and provision of the Service
The Contract is concluded when Outlet Legale receives the request for the Service and receives the relevant payment from the Customer.
Outlet Legale undertakes to provide the service within 48 working hours from receipt of the request formulated by the customer, by sending the customer an e-mail with the name, contact details and other essential data (such as VAT number, Bar Association, etc. of the identified legal advisor) of the identified legal advisor who has declared himself available to provide the requested legal services, as well as to formulate the relevant quotation (not binding in any way for the Client) under terms and conditions consistent, in their essential terms, with the characters from time to time specified on the Outlet Legale t portal in relation to each type of legal advice service as illustrated on the Outlet Legale portal.
Without prejudice to the possibility for the Client to avail itself of the assistance of the Outlet Legale staff at any stage, it is the Client’s express responsibility to contact the Legal Advisor directly in order to finalize the legal advice agreement and to execute the relevant professional engagement.
If for any reason the Customer does not wish to instruct the Legal Advisor appointed by Outlet Legale and/or such Legal Advisor does not deem it appropriate to accept the appointment, Outlet Legale shall endeavour to find a new Legal Advisor for the Customer’s benefit within 48 hours from the Customer’s request. If for any reason the Customer does not wish to instruct the second legal advisor identified by Outlet Legale and/or such legal advisor does not deem it appropriate to accept the appointment, Outlet Legale shall endeavour to find a third legal advisor for the Customer’s benefit within 48 hours of the Customer’s request for such advisor. If for any reason the Customer does not wish to appoint even the third legal advisor identified by Outlet Legale and/or such legal advisor does not deem appropriate to accept the appointment, the Customer shall be entitled, at its sole discretion, to request Outlet Legale to proceed with the identification of another legal advisor or, alternatively, to terminate the agreement and obtain the refund of the amount paid to Outlet Legale as remuneration for the Service.
Obligations of Outlet Legale
Pursuant to the contract concluded with the customer, Outlet Legale undertakes the following activities:
– obtain from the customer all the information necessary to provide the service, reserving the right to contact the customer by phone and/or email every time it is necessary to obtain from the customer further information than that originally provided;
– following the scouting and comparison activity, to identify on behalf of the Client, within 48 working hours from the request for the provision of the Service made by the Client, a Legal Advisor (duly registered in the Register of Lawyers kept by the relevant Bar Association), having his domicile within a radius of 50 km from the Client’s domicile, who is willing to offer his professional services to the Client, submitting to him a quotation for legal advice with terms and conditions consistent, in their essential terms, with the characters from time to time illustrated on the Outlet Legale portal in relation to the type of legal advice service of specific interest to the Client;
– assist the customer in case of problems arising in the management of the relationship between the customer and the legal advisor identified by Outlet Legale.
Outlet Legale also undertakes to manage the processing of the Customer’s personal data, received by it as a result of the Contract, in conditions of absolute security and confidentiality and in full compliance with the applicable laws on privacy (Legislative Decree no. 196 of 30.6.2003).
Customer’s obligations
The customer expressly instructs Outlet Legale to contact on behalf of the customer one or more legal advisors and request the formulation of a quotation (in no case binding for the customer) concerning the legal advice service of specific interest to the customer.
In order to enable Outlet Legale to provide the Service, the Customer undertakes to provide Outlet Legale with true, exhaustive and complete information and data, both at the time of request of the Service and also subsequently.
The Customer also undertakes
– not to use the service to make communications that may cause damage, harassment or disturbance to third parties (or in any way violate existing laws), nor for the dissemination of any material of a defamatory, obscene, profane, racist, pornographic or otherwise contrary to morality;
– not to use the service in violation of the rules on the protection of privacy and confidentiality, or to disseminate copyrighted material without the consent of the copyright holder;
– do everything in their power to safeguard their computer systems from access by unauthorised third parties, also by means of computer viruses;
– indemnify and hold harmless Outlet Legale from any prejudicial consequence deriving from the violation of the above obligations.
The customer undertakes to promptly notify Outlet Legale of any complaint, request for clarification and/or grievance relating to the services received, refraining from taking any legal action against Outlet Legale without having previously informed Outlet Legale of any difficulties.
Fees and Payments
The contractual fee, increased by VAT at 22% as required by law, shall be paid by the Customer at the time of sending the request for the provision of the Service in one of the following alternative ways:
– by credit card, also through the Paypal platform;
using an account or one of the most common credit cards.
– by bank transfer.
Any fee for legal advice provided by the Legal Advisor appointed by Outlet Legale shall be paid, in accordance with the quotation provided by the Legal Advisor, directly and exclusively into the hands of the same.
Warranties and Liability Limitations
Outlet Legale undertakes to carry out the scouting and comparison service with diligence and professionalism, within the limits of the assignment and the information received from the Customer. In no event shall Outlet Legale be liable for delays, malfunctions or interruptions of service due to unforeseeable events or force majeure, or in case of default, fraud or abuse by the Customer, a third party and/or the Legal Advisor appointed by Outlet Legale on behalf of the Customer. In particular, Outlet Legale guarantees that it will appoint on behalf of the Customer a legal advisor duly registered in the Register of Lawyers kept by the relevant Bar Association. No warranty is given by Outlet Legale with regard to the out-of-court and in-court advice (and the results of such advice) given by the legal advisor to the customer, nor with regard to the professional skills and the level of professional diligence to be performed by the legal advisor.
Right of withdrawal and “Satisfied or refunded” clause
The Client has the right to withdraw from the Contract within fifteen days from the sending of the request for Service through the Outlet Legale portal. The Customer declares in any case to be aware of the fact that the above-mentioned right of withdrawal cannot be exercised if the Service, fast for the same nature of the instrument used, has already been rendered in favour of the Customer. The notice of withdrawal must be sent, within the aforementioned term, by e-mail to info@outletlegale.com.
Without prejudice to the provisions of the last paragraph of art. 2, the customer shall in any case be entitled to receive, within seven days from the sending of the relevant request by e-mail to info@outletlegale.com, the full refund of the contractual amount paid to Outlet Legale in the event that Outlet Legale fails to fulfil its obligation to identify the customer, within 48 working hours from the customer’s request for service, a legal advisor (duly registered in the Register of Lawyers kept by the relevant Bar Association), having an address within a radius of 50 km from the customer’s address, who is available to offer his professional services to the customer in accordance with the terms and conditions of the contract.
Termination of the Contract
The Contract shall be considered terminated by right without the need for prior notice of default if the Customer fails to fulfil even partially the obligations under these terms and conditions. This is without prejudice to the right of Outlet Legale to claim for the payment of any greater damage suffered.
Applicable law
Any dispute arising out of or in connection with the performance and/or interpretation of the Contract, except for those expressly excluded by law, shall be settled exclusively by the Court of Milan. For all matters not expressly provided for or regulated by the Contract, reference shall be made exclusively to the rules laid down by the Italian legislative system.
